A lawyer’s role should be tied to a specific problem
Legal help may be useful when the insurer disputes eligibility, policy priority, the Minor Injury Guideline, treatment, income replacement, attendant care, catastrophic impairment or compliance with a request. It may also be useful before a recorded statement, insurer examination, settlement or Licence Appeal Tribunal application.
Not every administrative question requires representation. A focused review should explain the decision, identify the missing evidence and set out the realistic response options.
Coverage now depends more heavily on the actual policy
As of July 1, 2026, medical, rehabilitation and attendant-care benefits remain mandatory, while the other accident benefits are optional for policies entered into on or after that date. Existing customers may transition differently at renewal, depending on prior coverage and written elections.23
Two people injured in the same collision may therefore have different available benefits. Confirm the accident date, policy term, declarations page, endorsements and priority rules before relying on a benefits chart.
Every form should support the same accurate account
The OCF-1 starts the application. Other approved forms address disability, employment, treatment, expenses, elections and catastrophic impairment.4 Read each form before submission and keep the complete version with proof of delivery.
Match the evidence to the benefit
- Treatment requests need clinical reasoning and a functional goal
- Income claims need job, earnings and disability evidence
- Attendant care needs a careful account of required assistance
- Catastrophic applications need criterion-specific professional evidence
- Priority disputes need policy and household information

A denial is the start of an analysis, not necessarily the end of the benefit
Accident-benefit disputes are generally resolved through the Licence Appeal Tribunal’s Automobile Accident Benefits Service. Its application, case conference, disclosure and hearing process should be approached issue by issue.5
Before filing, confirm that the insurer has made a reviewable decision, identify the disputed amount or entitlement, assemble the supporting record and examine the applicable timing. Continuing to send generic medical records may not answer the reason given.
