Uninsured and underinsured are related but different coverage problems.

An uninsured claim asks whether valid liability insurance responds at all. An underinsured claim compares the responsible driver’s available limits with family-protection coverage and the proven claim.2

Other defendants, owners, employers or policies should be investigated before limits are treated as fixed. Coverage positions should be obtained in writing.

04 · Timing and decisions

Give notice before the coverage investigation is complete.

Policy conditions may require prompt notice and cooperation. Keep proof and avoid relying on oral assurances.3

Limitation and contractual timing should be analyzed for each insurer and defendant separately.
