Ontario legal information · Ottawa and Eastern Ontario

01 · Understanding the issue

Start with the real change, then test the legal route.

Compare the stated reason with the governing benefit test and the evidence the insurer says it reviewed.2

Do not assume that sending another medical note changes the original dispute date or produces a new decision.

02 · Insurance and responsibility

Keep the connected questions separate.

Benefit entitlement

Identify the specific benefit and amount at issue.

Clinical and functional proof

Target the factual or clinical gap in the insurer’s reasoning.

Insurer decision

Use internal clarification or LAT procedure as appropriate.

03 · Evidence

Build a record that another person can verify.

01First record

Full OCF-9 and delivery date.

02Medical course

Records relied on or omitted by the insurer.

03Daily function

Current function and claimed need.

04Decision documents

Follow-up letters, approvals and denial chronology.

Keep the complete notice, attachments and envelope or delivery record.
04 · Timing and decisions

Protect the next decision before the record is complete.

Calendar the decision immediately and obtain advice on the applicable LAT limitation.3

Request clarification promptly, but do not let informal discussion hide the approaching dispute date.

05 · When legal help may matter

How a personal injury lawyer may help with accident benefits.

A useful review should reduce the file to a defined benefit, disputed period, governing test and evidence problem—then explain the available response in plain language.

  • Parse every decision separately
  • Compare reasons with the legal test
  • Answer material evidence gaps
  • Protect LAT timing

Not every file requires every step or legal representation. The work should respond to the actual dispute, evidence gap or decision that is approaching.
