“Standard coverage” may mean different things at different policy dates.
Confirm the policy’s issue or renewal date, named insureds, vehicles, selected accident benefits and endorsements. A household may have more than one automobile policy with different selections.2
Optional coverage can affect income replacement, caregiving, housekeeping, death and funeral payments, dependant care or benefit limits. Entitlement still requires the applicable SABS test and evidence.
Read the coverage in three layers.
Policy period
Identify whether the policy falls before or after the July 1, 2026 transition.
Selected benefits
Use the declaration and endorsements to identify purchased coverage and limits.
Entitlement evidence
A purchased benefit still requires proof that the claimant meets its definition and loss requirements.
Keep both the purchase record and the claim record.
Obtain the complete declarations for every potentially applicable policy.
Keep forms showing increased limits, family protection or other selected coverage.
Preserve notices and selections connected with the applicable renewal.
Match employment, care, expense and medical proof to the benefit claimed.
Coverage should be verified before settlement or benefit elections.
Ask the insurer to identify the applicable benefit schedule and policy documents in writing. Compare the accident date with the policy period and renewal date.3
A coverage disagreement and a denial of entitlement are not always the same issue. Keep the reasons and review routes separate.
How a personal injury lawyer may help with accident benefits.
A useful review should reduce the file to a defined benefit, disputed period, governing test and evidence problem—then explain the available response in plain language.
- Identify the governing policy period
- Confirm selected benefits and increased limits
- Match each claimed benefit to its legal test
- Coordinate optional coverage with LTD and civil damages
Not every file requires every step or legal representation. The work should respond to the actual dispute, evidence gap or decision that is approaching.
